1. General
These Membership Terms and Conditions (“Terms”) govern the relationship between Apollons Gym (SIA “ApollonsFizio”), registration number 40203431530, with its registered legal address at Uliha iela 77‑15, Liepāja, LV‑3401, studio address: Cēsu iela 20, Riga, LV‑1012 (further “Apollons Gym”), and you, the member (further “member”, “you”, “your”). By purchasing or activating a membership with Apollons Gym, you agree to abide by these Terms.
2. Membership
Memberships are personal, non-transferable, and may not be shared, unless otherwise agreed with Apollons Gym.
Your membership begins on the date of purchase unless otherwise specified.
Access to facilities, classes, and services depends on your chosen membership type.
Membership is available from the age of 16. For members aged 16 to 18, these Terms - including the “Health” section - must be accepted by a parent or legal guardian, who assumes responsibility for the minor’s membership and compliance with these Terms.
3. Facility Access
Apollons Gym operates 24/7 as a self-service facility, using a digital access control system (Kisi). Staff are not present on the premises at all times.
Access is granted automatically based on your class or session booking. You have access to the facility from 15 minutes before your scheduled session to 15 minutes after it ends, allowing time to change in the dressing room before and after training.
You must not share your access credentials (app login, access code, or equivalent) with any other person. People who are not Apollons Gym members may enter and remain on the premises only together with a member holding a valid booking, and only for the duration of that booking (see Guests and Children). Admitting anyone who is not accompanied by a member with a valid booking is not permitted (“tailgating” or “door-holding” for others is not permitted). This does not apply to participants in a trainer-led session booked under a valid agreement with Apollons Gym (see Personal Training and Group Sessions).
A maximum of 5 people may be present during a single session, including the member, their guests, and any children. A personal trainer or group session instructor using the premises under a valid agreement with Apollons Gym is not counted toward this limit. You may only access the facility during a session for which you hold a valid booking.
Guests and Children. For the purposes of these Terms, a “guest” is a person aged 16 or over who is not an Apollons Gym member, and a “child” is a person under the age of 16. A member may bring guests and children to their booked session, provided the maximum of 5 people is not exceeded. No additional fee is charged and no additional session credit is deducted for guests or children. Guests and children may enter and remain on the premises only together with the member, and may not remain after the member leaves. Everyone present on the premises must follow the Facility Rules, whether or not they are a member. The member is fully responsible for their guests and children - for their safety, their behaviour, their compliance with these Terms including the Facility Rules, and for any damage they cause (see Damage to Property). It is the member’s responsibility to make their guests aware of these Terms before the visit. By bringing a guest, the member confirms that the guest is physically fit and able to take part in exercise and is not aware of any health condition that would make training unsafe. Guests use the facility and equipment at their own risk. Apollons Gym does not hold a health declaration for guests and does not supervise their training. Children must remain under the member’s direct supervision at all times and may not be left unsupervised in any part of the premises, including the training area. Children may not use equipment or climb on it. By bringing a child, the member confirms that they are the child’s parent or legal guardian, or that they have that person’s consent. A guest may not provide personal training or coaching services to the member or to anyone else (see Facility Rules). Apollons Gym reserves the right to ask that a guest’s or child’s visit be ended where it creates a safety, hygiene, or disturbance risk, and to refuse entry to a guest who has previously breached these Terms.
Misuse of the access system - including unauthorized entry, credential sharing, or exceeding session capacity - may result in suspension or termination of your membership.
Apollons Gym reserves the right to request that a member confirm their identity - for example, by comparing their name in the app to a form of identification - where there is reasonable cause to suspect unauthorized use of access credentials. Failure to cooperate with such a request may result in suspension or termination of membership (see Termination).
4. Session Validity
Individually purchased sessions expire 14 days from the date of purchase if unused.
Sessions included as part of a monthly membership expire at the end of that billing cycle if unused.
Expired sessions are forfeited and are not refunded or carried over, except where required by law (see Cancellations & Refunds).
The expiry of session validity does not affect the member’s 14-day right of withdrawal (see Cancellations & Refunds). Where the right of withdrawal is exercised, the refund is calculated on sessions not actually used at the time of the withdrawal request, regardless of their validity period.
5. Payments
Membership fees must be paid in advance, either monthly, yearly, or as otherwise agreed.
Failed or late payments may result in suspension of access until payment is received in full.
All prices include applicable taxes unless otherwise stated.
6. Cancellations & Refunds
You may cancel your membership by providing at least 7 days’ written notice prior to your next billing date.
Refunds are not issued for unused membership periods, except where required by law.
Members who purchased online are entitled to a 14-day statutory withdrawal period under EU consumer law, during which they may cancel their purchase for a full refund, provided services have not yet been used.
Once services are used within the withdrawal period, only a proportional refund (if applicable) will be granted.
7. Membership Freeze
Members with a recurring membership may freeze their membership for up to 30 days, once per calendar year.
Billing is paused for the duration of an approved freeze. Your membership and billing will automatically resume at the end of the freeze period. Unused sessions included in the membership are not lost during a freeze - their validity period is paused and resumes together with the membership at the end of the freeze period. Sessions cannot be booked and the premises cannot be accessed while a membership is frozen.
Freeze requests must be submitted in advance in written form and are subject to Apollons Gym’s approval.
8. Session Bookings & Attendance
Sessions have a fixed start and end time based on your booking. Arriving late does not extend your session - it will still end at the originally scheduled time.
You must vacate the training area by the end of your booked session to allow the next member’s session to begin without delay.
Remaining in the facility more than 15 minutes after your booked session end time will be treated as an additional reservation. Where this is identified, an additional session credit will be deducted from your account accordingly.
Repeated failure to vacate on time, causing delay to other members, may result in a warning, booking restrictions, or further action (see Termination).
Sessions must be booked in advance through the app or Apollons Gym website.
Late cancellations (less than 8 hours before the session) or no-shows may result in penalties (e.g., loss of booking credits, fees, or temporary booking restrictions).
Apollons Gym reserves the right to modify the booking schedule or close the facility where necessary. Schedules for trainer-led sessions are set by the trainer (see Personal Training and Group Sessions).
Where personal training sessions are booked and paid for directly through the Apollons Gym app (once available), the same 8-hour cancellation policy applies: cancellations within 8 hours of the session, or no-shows, will be charged the full session amount with no refund. This does not apply to personal training arranged directly with a trainer outside the app - see Personal Training and Group Sessions.
9. Personal Training and Group Sessions
Personal training, coaching, and group sessions at Apollons Gym are provided by independent trainers who arrange use of the premises separately with Apollons Gym (SIA “ApollonsFizio”). These trainers are not employees or agents of Apollons Gym. Fees for personal training and group sessions are payable directly to the trainer, not to Apollons Gym. Pricing, scheduling, booking, and cancellation terms for these sessions are set by the trainer, not by Apollons Gym, unless otherwise stated. Apollons Gym is not responsible for invoicing, collecting, or refunding these fees, and is not a party to any agreement between a trainer and their client. Where a trainer books the studio for a personal training or group session, the maximum of 5 participants applies; the trainer is not counted toward this limit. Participants attend as clients of the trainer and do not need a separate Apollons Gym membership or booking for that session. The trainer is responsible for their participants while on the premises, including their compliance with the Facility Rules. Everyone attending a trainer-led session must follow the Facility Rules and the Health section of these Terms. Apollons Gym does not collect a health declaration from participants who are not members and does not supervise trainer-led sessions. Where personal training or group sessions are booked and paid for directly through the Apollons Gym app in the future, additional or updated terms will apply and will be communicated to members separately.
10. Health
By signing up, you confirm that you are physically fit and able to participate in exercise activities.
You must disclose any relevant health conditions, injuries, or concerns via your health declaration at sign-up, or by contacting Apollons Gym directly.
You use Apollons Gym facilities and equipment at your own risk. Apollons Gym is not liable for injuries, accidents, or health issues unless caused by Apollons Gym’s proven negligence.
Guests and children brought onto the premises by a member, and participants attending a trainer-led session, use the facility and equipment at their own risk. Apollons Gym does not collect a health declaration from them and is not liable for injuries, accidents, or health issues affecting them, unless caused by Apollons Gym’s proven negligence. The member who brings a guest or child is responsible for confirming they are fit to be present and to take part in any activity they undertake (see Facility Access); for trainer-led sessions, that responsibility rests with the trainer (see Personal Training and Group Sessions).
11. Conduct
All members must treat staff, trainers, and other members with courtesy and respect, and are expected to use the facility considerately - keeping shared spaces clean and tidy for others.
Misuse of facilities, disruptive behavior, or violation of gym rules is a breach of these Terms - see Termination.
Damage to Property. Members are responsible for using equipment and facilities properly. Any damage caused by misuse, negligence, or intentional actions may result in the member being charged the cost of repair or replacement, unless otherwise agreed with Apollons Gym.
12. Personal Belongings
Apollons Gym is not responsible for loss, theft, or damage to personal belongings brought into the facility, including items stored in lockers.
Lockers may be used only during your session and must be emptied and left unlocked when you leave.
Members are responsible for bringing their own padlock to secure a locker during use.
Any locker found locked after a member’s session has ended may be opened by Apollons Gym, and its contents removed, without further notice.
13. Facility Rules
The following are not permitted on Apollons Gym premises:
- Smoking or vaping
- Consuming alcohol, or entering the facility visibly under the influence of alcohol or drugs
- Shaving in the shower
- Dyeing, bleaching, or otherwise treating hair in the shower
- Consuming food in the training area (water and sports drinks are permitted)
- Dropping, misusing, or otherwise damaging equipment through improper use
- Failing to re-rack weights, return equipment after use, or wipe down equipment with the provided disinfectant after use
- Photographing or filming other members without their consent
- Filming, photographing, or recording for commercial purposes, or conducting advertising, promotional, or canvassing activity on the premises, without Apollons Gym’s prior written consent
- Providing personal training or coaching to other members without prior authorization from Apollons Gym (SIA “ApollonsFizio”)
- Any other activity that may damage the facility, block or damage plumbing, or create a hygiene or safety hazard for other members
- Attaching aftermarket parts or accessories to equipment, or combining personal equipment with Apollons Gym equipment, in a way that could cause damage or accelerated wear
- Wearing masks, costumes, or any clothing, accessory, or equipment that fully or partially covers the face or otherwise hinders identification, at any time on the premises, except where there is a legitimate reason (such as religious head coverings, medical needs, or weather-related clothing that does not obscure the face)
- Triggering an emergency alarm or emergency response without a genuine emergency. Emergency systems, including exits, are monitored by camera; unauthorized or false triggering resulting in an emergency service dispatch may result in the member being charged the associated costs (see Damage to Property) and/or suspension or termination of membership (see Termination)
- Bringing animals of any kind onto the premises
- Creating excessive noise between 23:00 and 07:00, in accordance with applicable Latvian noise regulations
- Relocating, moving, or adjusting the settings of the sound system, other than connecting via Bluetooth and adjusting the volume
- Touching, leaning on, climbing on, or otherwise risking damage to the facility’s mirrors, including their attached lighting and motion sensors - normal use and adjustment of the lighting is permitted, but tampering with, disconnecting, or attempting to alter the sensor or wiring is not
Members are expected to wear appropriate attire, including closed-toe shoes suitable for safe exercise. Outdoor/street shoes must be changed for separate indoor training shoes before entering the training area, to help keep the space clean and hygienic.
Violation of these rules may result in the member being charged for any resulting damage or cleaning costs (see Damage to Property) and/or suspension or termination of membership (see Termination).
These rules apply to everyone on the premises, including members, guests, children, trainers, and participants in trainer-led sessions. Where a rule is broken by a guest or child, the accompanying member is responsible; where it is broken by a participant in a trainer-led session, the trainer is responsible.
14. Termination
For minor or first-time breaches of these Terms, Apollons Gym (SIA “ApollonsFizio”) may, at its discretion, issue a warning before applying suspension, booking restrictions, or termination. Repeated or serious breaches may result in immediate suspension or termination without a prior warning.
Apollons Gym may suspend or terminate a membership without refund in the event of a material breach of these Terms, including misconduct, misuse of the access system, or non-payment of fees not resolved within 30 days of notice.
Termination for cause does not relieve the member of any fees owed up to the date of termination.
Apollons Gym may also terminate a membership for reasons unrelated to the member’s conduct - for example, discontinuing a membership type or ceasing operations - on at least 30 days’ notice. In such cases the member is refunded the pro-rata portion of any prepaid, unused period. The refund is made within 14 days of the termination date.
15. General Terms
Governing Law. These Terms are governed by the laws of the Republic of Latvia. Any dispute arising from these Terms shall be subject to the jurisdiction of the Latvian courts, unless otherwise required by applicable EU consumer protection law.
Severability. If any provision of these Terms is found to be invalid or unenforceable under Latvian or EU law, the remaining provisions shall continue in full force and effect.
Electronic Acceptance. The member understands that signing these Terms electronically through the Apollons Gym app (via its Glofox-powered signing platform) constitutes a legally binding signature, equivalent to a handwritten signature, and confirms their agreement to all terms herein.
Force Majeure. Apollons Gym shall not be liable for any failure or delay in performing its obligations under these Terms where this results from circumstances beyond its reasonable control, including but not limited to natural disasters, fire, flood, government action, utility failures, or extended equipment or facility damage. If the studio is closed as a result of such circumstances, Apollons Gym will make reasonable efforts to inform members in good time. Where the disruption lasts up to 7 days, Apollons Gym will offer an extension of the membership period or training credits corresponding to the length of the disruption. Where the disruption lasts longer than 7 days, the member may choose between an extension of the membership period for the duration of the disruption or a pro-rata refund for the period during which the service was unavailable.
16. Data Protection
Apollons Gym (SIA “ApollonsFizio”) is the data controller responsible for personal data collected in connection with your membership.
What Apollons Gym collects
- Security camera footage recorded within the premises
- Digital access records (entry and exit times) via the access control system (Kisi)
- Account, booking, and payment information via the booking platform (Glofox)
- Health declarations you provide at sign-up
Why Apollons Gym collects it, and its legal basis
- CCTV footage and access logs: for security, incident review, and crime prevention (legitimate interest)
- Booking and payment data: to manage your membership and deliver services (performance of contract)
- Health declarations: to support your safety while training (your explicit consent)
Retention
CCTV footage and access logs are retained for no longer than 14 days, after which they are permanently deleted, unless retention is necessary for a specific, documented purpose - such as an active incident investigation, a legal claim, or a request from law enforcement or another competent authority - in which case the relevant footage will be retained only for as long as that purpose requires. Booking and payment records are retained for as long as required to manage your membership and to meet Apollons Gym’s legal and accounting obligations. Health declarations are retained while the membership is active and are deleted no later than 12 months after the membership ends, unless retention is necessary for bringing or defending a legal claim.

If you wish to request footage in which you appear, contact Apollons Gym at info@apollonsgym.lv.
Third parties
Some data is processed on Apollons Gym’s behalf by Apollons Gym’s booking and access-control providers (Glofox and Kisi) as data processors.
Guests, children, and trainer-led session participants
Where a member brings guests or children, or where a person attends a trainer-led session, they may appear in security camera footage. This data is processed for the same purpose and retained for the same period as all other CCTV footage (see Retention). The member is responsible for ensuring that the guest - or, in the case of a child, their parent or legal guardian - is aware of this processing; for trainer-led sessions, the trainer is responsible for informing their participants.
Members under 18
For members aged 16 to 18, registration, the health declaration and acceptance of these Terms are confirmed by a parent or legal guardian. In such cases Apollons Gym also processes the parent’s or guardian’s name, surname and contact details in order to evidence that consent.
Your rights
You have the right to request access to your personal data, its correction or erasure, to object to processing based on legitimate interests, to request restriction of processing, to receive your data in a structured, commonly used format, and to withdraw consent at any time (this does not affect the lawfulness of processing carried out before withdrawal). To exercise these rights, write to info@apollonsgym.lv. If you believe your data is being processed unlawfully, you have the right to lodge a complaint with the Data State Inspectorate (Datu valsts inspekcija, www.dvi.gov.lv).
17. Changes to Terms
Apollons Gym reserves the right to update or amend these Terms, including membership pricing, from time to time. Material changes, including price increases, will be communicated to members at least 30 days before taking effect. This notice period does not apply to price decreases.
If a change to these Terms negatively affects you, you may cancel your membership without penalty by providing written notice within 30 days of the change taking effect. If you do not provide notice within this period, you will be deemed to have accepted the change.
Minor administrative changes that do not materially affect members may take effect immediately upon publication.

For any questions regarding your membership or these Terms, please contact Apollons Gym via info e-mail: info@apollonsgym.lv.
If you have a complaint, please submit it in writing to the same email address, stating your name, surname, contact details, the date and a description of the issue. Apollons Gym will provide a written response within 15 working days of receiving the complaint. If a response cannot be given within that period for objective reasons, Apollons Gym will notify you in writing of another reasonable deadline and the reason for it.
If the complaint cannot be resolved between us, you have the right to apply to the Consumer Rights Protection Centre (Patērētāju tiesību aizsardzības centrs, www.ptac.gov.lv) or the Consumer Dispute Resolution Commission, and to bring a claim before a Latvian court as set out in the “General Terms” section.
